Dynamics of EOT Claims in Construction Projects

Dear BIVILLEPM Community,

There is a difference between experiencing a Delay EOT Claim vs. a Disruption EOT Claim, and learning it solely from a classroom setting. The distinction lies in having a system to measure productivity and witnessing its decline, along with having systems to document delays and accumulate them. The only potential obstacle to the EOT Claim’s acceptance is an initial estimate from the baseline that is deemed unreasonable and contract clauses the prevents Claims.

If the contractor is potentially operating at a loss due to circumstances beyond their control and has provided ample evidence for compensation, they possess a contractual right to demobilize from the site if the client (asset owner) refuses to cooperate.

While I don’t always advocate for inflexibility, I believe many projects can be abandoned or suspended due to someone being too rigid contractually, whether it’s the asset owner or the contractor who has nothing much to lose as a result.
